TERMS AND CONDITIONS OF NEXT PARCEL LTD

 

Application and Entire Agreement

 
1.1 These terms and conditions (“Terms”) apply to the provision of delivery services (“Services”) by Next Parcel Ltd (“we”, “us”, or “our”). By engaging us to provide such services, you agree to be bound by these Terms.
 
1.2 These Terms constitute the entire agreement between us and you, and supersede any prior agreements, whether written or oral, relating to the services provided by us.

Interpretation

 
2.1 In these Terms, the following words have the following meanings:
 
“Parcel” means any goods or items that are transported or delivered by us.
“Services” means the delivery services that we provide to you.
“You” or “your” means the person, firm, or company that engages us to provide the Services.
 

Services

 
3.1 We will provide the Services to you with reasonable care and skill, in accordance with these Terms.
 
3.2 We will use reasonable endeavours to deliver the Parcel to the delivery address you provide to us, within the agreed timeframe. However, we cannot guarantee delivery times, and we will not be liable for any delay or failure to deliver the Parcel on time.
 
3.3 We may engage third-party carriers or sub-contractors to perform the Services on our behalf. However, we will remain responsible to you for the performance of the Services by such third-party carriers or sub-contractors.
 

Your Obligations

 
4.1 You will provide us with all necessary information and instructions in order for us to perform the Services, including the details of the Parcel, the pickup and delivery locations, and any special requirements.
 
4.2 You warrant that you have the right to transport and deliver the Parcel, and that the Parcel does not contain any illegal, dangerous, or hazardous goods.
 
4.3 You will ensure that the Parcel is packaged properly and securely, in accordance with any relevant regulations or industry standards.
 
4.4 It is your responsibility to provide correct service details including postcodes, addresses, dates, times and all of the service details. NextParcel is not responsible for any loss or negative situations caused by your mistakes. If you provide us wrong details for the service and it is causing a cancellation or amendment, we will charge you the way how it is described in our Cancellation and Amendment policy.

Fees

 
5.1 The fees (Fees) for the Services are set out in the quotation and are on a time and materials basis. We will provide you with a quotation for the Services, based on the information you provide to us.
 
5.2 You must pay our fees for the Services in accordance with the payment terms set out in these Terms.
 
5.3 In addition to the Fees, we can recover from you a) reasonable incidental expenses including, but not limited to, travelling expenses, hotel costs, subsistence and any associated expenses, b) the cost of services provided by third parties and required by us for the performance of the Services, and c) the cost of any materials required for the provision of the Services.
 
5.4 You must pay us for any additional services provided by us that are not specified in the quotation in accordance with our then current, applicable hourly rate in effect at the time of performance or such other rate as may be agreed between us. The provisions of clause 5.3 also apply to these additional services.
 

Cancellation and Amendment

 
6.1 For cancellation please send us an email with the customer name and confirmation number and we will cancel the service for you, our cancellation email address is cancellation@nextparcel.co.uk. You can cancel the service free of charge anytime 24 hours prior to the booked service time, in that case you will receive a full refund. If the service is cancelled less than 24 hours prior to the booked service time we will charge on you the 70% of the agreed total price, and you will receive a 30% refund from the total price. If the service is cancelled on pick up point we will charge on you the 70% of the agreed total price, and you will receive a 30% refund from the total price.
 
6.2 We reserve the right to cancel or amend the Services at any time, without liability to you, if we are unable to perform the Services due to circumstances beyond our control.
 
6.3 If you want to amend any details of the Services you must tell us in writing as soon as possible on info@nextparcel.co.uk. We will use reasonable endeavours to make any required changes and additional costs will be collected from you. If we can not deliver the parcel or items to the drop off point because they are closed or refusing to receive it from us, we will contact you and there will be an additional cost that we charge on you, depending on the circumstances (time, distance, location).
 

Payment

 
7.1 You will pay our fees prior to the services through a secured payment gateway with bank card or credit card unless otherwise agreed in writing.
 
7.2 If there would be any additional cost because of waiting time or any other circumstances, we will contact you to confirm the details and the amount of additional cost, and we will collect the agreed amount from you. Please see additional cost prices in the Waiting Time and Handball paragraph. If you fail to pay our fees within a 30 days timeframe, we may charge you interest on the overdue amount, at the rate of 4.25% per annum above the base lending rate of the Bank of England from time to time on the amount outstanding until payment is received in full. We may also suspend the provision of the services until payment is made.
 
7.3 All payments must be made in British Pounds unless otherwise agreed in writing between us.
 

Waiting Time and Handball

 
8.1 If our driver has to wait at the pick up point or drop off point more than 30 minutes for loading in or unloading the delivery load, we will have to charge on you an additional cost. In this case we will contact you about the additional price. After 30 minute waiting at pick up point or drop off point we will charge on you additionally £30+VAT/hour from small vehicles to extra long van and £60+VAT/hour for luton van or bigger vehicles.
 
8.2 Additional charges can also apply if the driver has to do handball that wasn’t agreed prior to the services, in this case we will contact you and a handball fee will be charged on you. Handball fee basic is £30+VAT until the first 200kg and an additional £0.1+VAT/kg on the top of the 200kg.
 

Refund

 
9.1 At an event of cancellation you are eligible for a refund, the amount of refund is depends on the circumstances of the cancellation that is declared in this T&Cs 6.1 paragraph. After your cancellation we will start your refund process as soon as possible. By accepting our terms and conditions you confirm that you are aware of the refund amount can reach your bank account in a 30 days period after the start of the refund process.
 

Sub-Contracting and Assignment

 
10.1 We may sub-contract or assign our rights and obligations under these Terms to any third party, without your consent.
